1. Acceptance

By accessing or using JPitch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Finally, LLC, a Georgia company ("we," "us," or "our").

2. Description of service

JPitch is a web-based Japanese pitch accent practice tool. It allows registered users to record themselves speaking Japanese words and receive real-time pitch contour analysis graded against native dictionary patterns. The Service is provided "as is" and may be updated or changed at any time.

3. Account registration

You must create an account to use the full Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date. You must be at least 13 years old to create an account.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract proprietary algorithms from the Service.
  • Scrape, crawl, or systematically extract data from the Service without written permission.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Create multiple accounts to circumvent limitations or restrictions.

5. Intellectual property

All content, design, and proprietary algorithms of JPitch are owned by Finally, LLC and are protected by copyright and other intellectual property laws. The pitch analysis algorithms are proprietary and may not be reproduced, copied, or distributed without written permission.

The Service incorporates open-source linguistic data sources used in accordance with their respective licenses. Pitch accent data is sourced from UniDic, © National Institute for Japanese Language and Linguistics (NINJAL), BSD license. Tokenization is powered by kuromoji, Apache 2.0 / IPAdic BSD license.

6. Audio recordings

When you use the pitch analysis feature, you grant us a limited, temporary license to process your audio recording solely for the purpose of performing pitch analysis. Your recordings are processed immediately and never stored. No rights to your voice or recordings are retained by us.

7. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that pitch analysis results will be perfectly accurate. Use the Service as a learning aid, not as a definitive linguistic authority.

8. Limitation of liability

To the fullest extent permitted by law, Finally, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may close your account at any time by contacting us at support@finallystudy.com.

10. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Georgia.

11. Changes to these terms

We may update these Terms at any time. We will update the date at the top of this page when we do. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
